Ernest Orville Baldree, henceforth appellant, was twice indicted for committing the offense of capital murder. One indictment alleges in pertinent part that he murdered Homer Howard while in the course of attempting to commit or committing the offense of robbery of Homer Howard. The other indictment alleges that he murdered Nancy Howard while in the course of attempting to commit or committing the offense of robbery of Nancy Howard. See V.T.C.A. Penal Code § 19.03 (a) (2). Appellant was related by marriage to the Howards. The record reflects that when the murders of Nancy and Homer occurred, appellant had recently been released from the Department of Corrections to parole status and was then living in Navarro County with one of his sisters, Margie, and her husband, Lee Roy Howard.
